These Terms and Conditions ("Terms") outline the agreement between Quality Homemakers Canada ("Company," "we," "our," or "us") and you, the client ("Client," "you," or "your"), regarding the provision of personalized home care services. By using our services, you agree to these Terms, forming a binding agreement between you and the Company.
Our goal is to provide high-quality, personalized care services that support your independence, comfort, and well-being while maintaining the highest standards of professionalism and ethics.
2. Services Provided
We offer a complete range of home care services tailored to meet the unique needs of each client. Our services include:
- 1. Companionship:
- Providing social interaction to reduce feelings of isolation and promote emotional well-being.
- Activities include engaging conversations, playing games, reading, or accompanying you to appointments or social outings.
- 2. Homemaking:
- Assistance with household tasks such as light cleaning, meal preparation, grocery shopping, and laundry.
- Ensuring a safe, clean, and comfortable living environment.
- 3. Personal Care Support:
- Helping with activities of daily living, including bathing, dressing, grooming, toileting, and mobility assistance.
- Focusing on maintaining dignity and respecting personal preferences.
- Live-In Support:
- Offering 24/7 care and supervision for clients who require continuous assistance.
- Live-in caregivers ensure safety and provide personalized support throughout the day and night.
- Enhanced Life Services (ELS):
- Specialized assistance tailored to specific needs, such as transportation for errands or unique requests that enrich daily living.
Custom Care Plans: All services are outlined in a personalized Service Agreement created after a thorough assessment to address the specific needs and goals of each client.
3. Client Eligibility and Assessment
To receive services from Quality Homemakers Canada, you must:
- Be a resident of Canada within the regions we serve.
- Require non-medical assistance with daily living tasks or support services.
- Participate in an initial assessment to determine your care needs.
Initial Assessment
The assessment process includes:
- Evaluating your physical, emotional, and social needs.
- Understanding your preferences for care and daily routines.
- Conducting a safety review of your home environment.
- Developing a care plan tailored to your requirements.
The assessment is conducted by experienced staff and aims to ensure that services align with your expectations.
4. Service Agreement
After the assessment, a Service Agreement is prepared, which outlines:
- The specific services to be provided.
- The schedule and frequency of service delivery.
- Fees associated with services, including any additional charges for specialized requests.
- Terms for cancellation, modification, or termination of services.
Both parties must review, agree to, and sign the Service Agreement before services commence.
5. Fees and Payment
Our fees are determined based on the care plan created during the assessment process. Below are the payment terms:
Invoices
- Invoices are issued bi-weekly for services rendered during the prior period.
- All invoices include a detailed breakdown of services provided and associated costs.
Payment Terms
- Payment is due within 14 days of the invoice date.
- Accepted payment methods include:
- - Credit cards
- - Electronic funds transfer (EFT)
- - Cheques
Late Payments
- Payments not received by the due date may incur late fees, as specified in the Service Agreement.
- Continued non-payment may result in service suspension or termination.
Fee Adjustments
- Fee adjustments may occur due to changes in the scope of services, additional requests, or updates in operational costs. Clients will be notified of such changes in advance.
6. Client Responsibilities
As a Client, you are expected to:
- Provide Accurate Information:
Share all relevant details about your health, preferences, and care needs during the assessment process.
- Communicate Changes:
Inform us promptly about any changes in your health, living situation, or care requirements.
- Maintain a Safe Environment:
Ensure that your home environment is safe for our caregivers to perform their duties. This includes addressing hazards such as poor lighting, clutter, or unsafe conditions.
- Adhere to the Service Agreement:
Comply with the agreed care plan, schedules, and recommendations provided by our staff.
7. Company Responsibilities
Quality Homemakers Canada is committed to providing professional and high-quality care. We agree to:
- Deliver Agreed Services:
Provide the services outlined in the Service Agreement consistently and to the best of our ability.
- Employ Qualified Staff:
Ensure all caregivers are trained, experienced, and capable of delivering compassionate and reliable care.
- Maintain Confidentiality:
Protect your personal and sensitive information as outlined in our Privacy Policy.
- Provide Regular Communication:
Keep you informed about service updates, caregiver schedules, or any necessary adjustments to the care plan.
8. Confidentiality and Privacy
Your privacy is of utmost importance to us. We adhere to Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), to ensure that your personal information is handled responsibly.
Collection and Use of Information
- Personal information is collected during the assessment and service delivery process.
- Information is used solely for the purpose of delivering care and improving service quality.
Disclosure
- We do not share your personal information with third parties without your consent, except as required by law.
9. Termination of Services
Either party may terminate the Service Agreement under the following conditions:
- By Client:
o Written notice of 14 days must be provided if you wish to terminate services for any reason.
- By Company:
Services may be terminated immediately in the following circumstances:
- Breach of these Terms or the Service Agreement.
- If your care needs exceed the scope of services we can safely provide.
- If safety concerns arise that cannot be mitigated.
10. Limitations of Liability
While we are dedicated to providing high-quality care, Quality Homemakers Canada is not responsible for:
- Injuries or harm caused by a Client's failure to follow recommended care instructions.
- Loss or damage to personal property.
- Incidents or issues arising from external factors beyond our control.
Our liability is limited to the maximum extent permitted under applicable Canadian laws.
11. Modifications to Services
Service modifications may be necessary due to:
- Changes in your health or living circumstances.
- Feedback provided by you or your family.
- Adjustments required for safety or service delivery improvements.
All modifications will be discussed with you and documented in an updated Service Agreement.
12. Governing Law
These Terms and Conditions are governed by the laws of Canada and the province in which services are delivered. Any disputes arising from these Terms shall be resolved under the jurisdiction of the applicable provincial courts.
13. Amendments
We reserve the right to amend these Terms and Conditions as needed to reflect changes in our services or legal requirements. Clients will be notified of any updates, and continued use of our services constitutes acceptance of the revised Terms.
